Abstract

All praise is due to Allah, the teacher of the faithful people, light of the heaven and earth, the guide to the clear religion. I witness that no God except Allah, All-Mighty. He has the kingdom of heavens and who has got good names and adjectives. I always witness that our prophet, Muhammad, may peace be upon Him, is his slave and messenger. And Allah has sent Him to be merciful, lighted candle to all mankind.

The research aims to declare the meaning of the passive crime and shows its controls; the temporal and immortal punishment. Moreover, its applications in real life and the solutions towards people. Then the research contains the prelude and four main chapters. In the prelude, I declared the meaning of the crime and its kinds. After that I linked between it and some related idioms. I finished it by treating the crimes according to the Islamic religion. And I got the idea that the passive crime is not giving the rights and duties towards others. As I see, Islam gradually began solving this problem through education, fear, willingness and punishment.

In the first chapter (the bases of the passive crime and its conditions) I defined the meaning of base of the crime, religiously, and materially.

In the second chapter (The legal adaptation for the passive crime) I made clear the causes and effects of the negative crime according to the Islamic teachings, discussed different opinions and rules. It was clear to me that the passive crime treated by the theory causes and effects and I noticed that the passive behavior equals the positive behavior when it causes pain to us. The wrong doers must be punished according to their crimes either by punishment or censure.

In the third chapter (the effects of acting the negative crime) I showed the painful results and the Islamic resolutions. The judge usually uses the censure.

In the fourth chapter ( The Fiqh Applications on the Passive Crime ) I mentioned in it examples, such as not fulfilling the prayers Azaka, fostering, witness, the wife's expense, the interference when it is necessary, I then declared with evidence of judges and the opinions of religious people on Fiqh about them. And what they arranged of punishments towards them now and after death. The researcher understood that not fulfilling these duties are sins, illegal methods and passive crimes. Consequently, Islamic religion punishes people who do wrong deeds either by punishment or censure.
